Welcome to Kultura Obskura ("kO," "we," "us," or "our"). By accessing or purchasing from kulturaobskura.com (the "Site"), you agree to the following Terms and Conditions. Please read them carefully.

1. About Kultura Obskura

Kultura Obskura is an independent, Filipino-inspired creative brand based in Vallejo, California. We design and sell limited-run goods inspired by Filipino culture, identity, and memory.

2. Limited Drops & Availability

Kultura Obskura releases products in limited, capped quantities. Once a drop is sold out, it is sold out — we do not guarantee restocks, additional runs, or extended availability unless explicitly announced.

Pre-orders are accepted only as explicitly stated on a given product listing. Estimated fulfillment timelines are estimates, not guarantees, and may be affected by production, shipping, or supplier delays outside our control. We will communicate known delays via Instagram (@kultura.obskura) and/or email when possible.

Placing an order does not guarantee fulfillment. In the rare case a confirmed order cannot be fulfilled (e.g., production shortfall, damaged inventory), we will issue a full refund.

3. Pricing & Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice prior to purchase completion. Once an order is placed and payment is processed, the price is final for that order.

Payment is processed securely through our e-commerce platform (Big Cartel) and its associated payment processors. Kultura Obskura does not store your full payment card information.

4. Charitable Donations

Select products may include a stated percentage of proceeds donated to a named charitable partner (for example, Child Fund Philippines). Where stated:

• The donation percentage applies to the listed product price for the relevant drop, as disclosed on the product page or accompanying marketing materials.
• Donations are calculated and remitted by Kultura Obskura directly; the charitable partner does not process your payment and is not a party to your purchase transaction.
• Donation totals are typically calculated and sent after a drop concludes (e.g., upon sellout or close of a pre-order window), not on a per-order basis in real time.
• Kultura Obskura will make reasonable efforts to publicly share confirmation of donations made, but is not obligated to provide individual donation receipts to customers.
  

5. Intellectual Property

All original designs, artwork, logos, copy, and brand elements created by Kultura Obskura are the property of Kultura Obskura and may not be reproduced, distributed, or used commercially without written permission.

Certain limited-edition products may reference or comment on third-party brand names, trademarks, or cultural symbols as a form of artistic or cultural commentary. Kultura Obskura is an independent brand and is not affiliated with, endorsed by, or sponsored by any third-party company referenced in our designs, including but not limited to Trader Joe's. Any such references are intended as expressive commentary and are not intended to cause consumer confusion as to source or sponsorship.

6. Returns, Refunds & Shipping

Please refer to our separate Returns and Refunds and Shipping and Delivery policies for full details. Those policies are incorporated into these Terms by reference.

7. Limitation of Liability

To the fullest extent permitted by law, Kultura Obskura shall not be liable for any indirect, incidental, special, or consequential damages arising from your purchase or use of our products or Site, including but not limited to delays in fulfillment, product unavailability, or third-party claims related to product content.

Products are sold "as is." We make reasonable efforts to accurately represent our products through photography and descriptions, but minor variations in color, material, or print placement may occur due to the handmade or small-batch nature of our goods.

8. User Conduct

When interacting with Kultura Obskura on our Site or social media channels, you agree not to engage in harassment, fraud, or any unlawful activity. We reserve the right to cancel or refuse orders we reasonably believe to be fraudulent or abusive.

9. Changes to These Terms

We may update these Terms and Conditions from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
